This Privacy Policy explains how Code Ninjas Tracy (“Code Ninjas Tracy,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information in connection with our website at trycodeninjas.com, our local marketing, and the programs and services we offer at our coding center located at 1841 W 11th St, Tracy, CA 95376. Code Ninjas Tracy is an independently owned and operated Code Ninjas center, operating under a franchise agreement with Code Ninjas, LLC.

The Code Ninjas national website (codeninjas.com), learning platforms, and point-of-sale systems are operated by Code Ninjas, LLC and are governed by its Privacy Policy at codeninjas.com/privacy. This Policy governs the information we collect at our location and through our website. By using our website or providing information to us, you agree to the practices described in this Policy. Our services are directed to residents of the United States.

Information we collect

We collect the following categories of personal information:

• Identification information you provide — your name, email address, mobile phone number, and country, and information about your child (such as first name, age, grade, interests, or learning needs) when you book a free Game Building Session, request information or resources, enroll, or contact us.
• Payment information — if you enroll, billing details are collected and processed by third-party payment processors on our behalf (including the membership and point-of-sale systems provided through Code Ninjas, LLC); we do not store full payment-card numbers on our own systems.
• Location information — the general area you are in, derived from your address or IP address, so we can serve the right center and local programs.
• Feedback and user-generated content — reviews, survey responses, messages, and photos or videos you or your child create or that we capture during sessions with your consent.
• Marketing preferences — your communication choices and opt-ins/opt-outs.
• Information collected automatically — when you visit our website we automatically collect device and usage information such as domain name, IP address, general location, browser and device type, pages viewed, referring links, and interactions, through cookies, web beacons, and similar technologies.
• Information from third parties — we may receive information from social media platforms, from advertising and analytics providers (such as Meta and Google), and from Code Ninjas, LLC in connection with lead generation and shared marketing.

How we use your information

• To provide our services and fulfill your requests — to schedule, provide, and follow up on free sessions, enrollments, classes, and events, and to communicate with you about your child’s participation and progress.
• To respond to your inquiries and provide customer service and support.
• For marketing and promotional purposes, including using your personal information, such as your email address and/or mobile phone number, to send newsletters, updates, offers, and other communications about our programs. You can opt out of marketing at any time.
• To operate, measure, secure, analyze, research, and improve our website, programs, and marketing.
• To protect our legal rights, enforce our agreements, and ensure the safety and security of our families, staff, and systems.
• To comply with applicable laws and regulatory obligations.

Cookies and tracking technologies

We and our service providers use cookies, pixels, web beacons, and similar technologies to operate the site, remember your preferences, measure performance, and support advertising. You can control cookies through your browser settings; disabling some cookies may affect site functionality.

How we share your information

Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell your personal information. Subject to the exclusion above for text-messaging opt-in data, we may share personal information:

• with service providers who perform functions on our behalf (such as email, scheduling, payment, hosting, IT, security, customer support, and analytics providers), under obligations to protect the information;
• with Code Ninjas, LLC and, where relevant, other franchised locations, which share personal information with each other for the purposes of providing the sites, portals, and services, managing accounts, hosting, IT, security, support, billing, marketing, and communications;
• with advertising and analytics partners (such as Meta and Google), with your consent where required, to help us measure ad performance and reach families who may be interested in our programs (this excludes text-messaging opt-in data);
• with law enforcement, regulators, and other legal third parties as required to comply with law, respond to legal process, or protect our rights, property, and the safety of others;
• in connection with a business transaction — such as a merger, acquisition, financing, or sale of all or part of the business (including the Tracy center), in which case personal information may be among the transferred assets.

You can control ad personalization through your Meta ad settings and Google Ad Settings, and manage cookies in your browser.

Mobile opt-in information collected for text messaging is excluded from all of the sharing described above — it is never shared with any third party or advertising partner for any purpose.

SMS messaging consent and communication

1. Consent to receive SMS messages. You voluntarily provide your mobile phone number to Code Ninjas Tracy and expressly consent to receive SMS messages for informational, transactional, and promotional purposes related to Code Ninjas services and offerings. Consent to receive text messages is not a condition of any purchase.

2. Message frequency. Code Ninjas Tracy may send SMS messages to the mobile phone number you provided. Message frequency varies and could include important updates, reminders, promotional offers, and transactional notifications.

3. Data charges. Message and data rates may apply to SMS messages sent and received, and you are solely responsible for any charges incurred from your mobile carrier for receiving SMS messages from us.

4. Opt-out and cancellation. If you wish to stop receiving SMS messages, you can opt out at any time by replying STOP to any message; this will unsubscribe you from further SMS communications and will not affect your other interactions with us. Reply HELP for assistance at any time.

5. Customer support. For assistance or questions regarding SMS messaging, contact us using the details in the “Contact us” section below.

6. Privacy and data usage. We will only use your mobile phone number for SMS communication as outlined in this Privacy Policy. We will not share your mobile phone number with third parties for marketing purposes. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. Governing law. This SMS Messaging Consent section is governed by the same laws and regulations as the rest of Code Ninjas Tracy’s Terms & Conditions.

By opting in to receive SMS messages from Code Ninjas Tracy, you acknowledge that you have read and understood this section and agree to its terms. If you do not agree with these terms, please do not provide your mobile phone number for SMS communication.

Children under 13

Our website and marketing are directed to parents and guardians, not to children. We support the Children’s Online Privacy Protection Act (“COPPA”) and work to minimize the information gathered from and disseminated about children under 13 while permitting them active participation in our educational programs. We do not knowingly collect personal information directly from children under 13 online. For information we collect at our center (such as a child’s first name, age, and progress records), a parent or guardian provides it to arrange a session, class, or enrollment; we collect only what is needed to deliver and improve our programs, and we do not use children’s information for marketing. Children’s use of the Code Ninjas learning platforms is governed by Code Ninjas, LLC’s Children’s Privacy Policy, available at codeninjas.com. If you believe a child has provided us information directly, please contact us and we will delete it.

Data retention

We keep personal information for as long as it is reasonably needed to provide our services, maintain our relationship with your family, and meet our legal, tax, and accounting obligations. When it is no longer needed for those purposes, we delete or de-identify it. If you ask us to delete your information, we will do so unless we are required to keep it by law.

Transfer and storage of data

Your information is stored and processed in the United States. If you access our services from outside the United States, you understand that your information will be transferred to, and processed in, the United States, where data protection laws may differ from those of your jurisdiction.

Data security

We take reasonable administrative, technical, and physical precautions designed to protect personal information, both online and offline. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your privacy rights

You can opt out of direct marketing from us at any time — use the unsubscribe link in any marketing email, or reply STOP to any marketing text. If you contact us about your personal information, we will respond to reasonable requests to access, correct, or delete it, to the extent required by applicable law.

If you are a California resident, you may ask us to access, correct, or delete the personal information we hold about you, and we will respond to the extent required by applicable law. WE DO NOT SELL YOUR PERSONAL INFORMATION. We do not sell personal information for monetary consideration. Like most businesses that advertise online, we may share limited identifiers (such as hashed email addresses and website activity) with advertising partners as described above, which may constitute “sharing” for cross-context behavioral advertising under the California Consumer Privacy Act (as amended by the CPRA); you may opt out by contacting us. This never includes text messaging opt-in data or consent, which is not shared with any third party.

California “Shine the Light” (Civil Code §1798.83): California residents may request information about our disclosure of personal information to third parties for those third parties’ own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

Do Not Track: We do not respond to Do Not Track (“DNT”) signals from browsers.

Third-party links

Our website may link to third-party sites and services (such as game platforms or payment providers) that have their own privacy practices. We exercise no control over, and are not responsible for, the privacy practices or content of those third parties.
